Terms of use

The short version: TheDayRate helps you keep track of your work and money, but you’re still responsible for your invoices and your tax. It’s an early version and it’s free for now. Your data is yours, and you can take it with you whenever you like.

1. About these terms

These terms are an agreement between you and Ben Campbell, trading as TheDayRate in Northern Ireland (“we”, “us”). They cover your use of TheDayRate, including the website and app at thedayrate.com. By creating an account you agree to them. If you don’t agree, please don’t use TheDayRate.

How we handle your personal information is explained in our privacy policy.

2. Who TheDayRate is for

TheDayRate is a tool for running a business, such as working as a self-employed sole trader. By using it you confirm that you’re 18 or over and using it for your business, not as a consumer.

3. Early access and price

TheDayRate is invite-only and still being built. Features will change, and some things may not work as they should. It’s free during early access. If we ever start charging, we’ll tell you at least 30 days beforehand, and you won’t be charged unless you agree.

5. Your data is yours

Everything you put into TheDayRate belongs to you. You give us permission to store and process it only so we can run TheDayRate for you. You can download a copy or delete it at any time from Settings.

You’re responsible for the information you add, including having a good reason to store your clients’ details.

6. Tax figures are estimates, not advice

Tax, National Insurance and mileage figures in TheDayRate are estimates to help you plan. They are not tax, legal or financial advice, and your own situation can change what you owe. Check with HMRC or an accountant before relying on them. You’re responsible for your invoices, your records and your tax returns, and for keeping records for as long as HMRC requires.

7. Using TheDayRate fairly

Don’t use TheDayRate to:

If you do, we may suspend or close your account.

8. Our software

TheDayRate, its design and its code belong to us. These terms give you permission to use it for your business while you have an account. They don’t give you ownership of any part of it.

If you send us ideas or feedback, we may use them to improve TheDayRate without owing you anything. We’re grateful for them all the same.

9. Other services

If you sign in with Google or Microsoft, their own terms apply to your account with them. We aren’t responsible for services we don’t run.

10. Availability and changes

We work hard to keep TheDayRate running and your data safe, but we can’t promise it will always be available or free of mistakes. We may change or remove features. If we ever close TheDayRate, we’ll give you at least 30 days’ notice so you can download your data.

Keep your own backups (Settings, then Your data) of anything you can’t afford to lose.

11. Our responsibility to you

TheDayRate is provided as it is, while it’s in early access. As far as the law allows:

Nothing in these terms limits our responsibility where the law says it can’t be limited, such as for death or personal injury caused by our negligence, or for fraud.

12. Ending your account

You can delete your account at any time in Settings. We may close your account with 30 days’ notice, or straight away if you seriously break these terms. Unless there’s a serious reason not to, we’ll give you the chance to download your data first.

13. Changes to these terms

If we change these terms in a way that matters, we’ll email you at least 14 days before the change takes effect. If you keep using TheDayRate after that, the new terms apply. If you don’t agree, you can delete your account.

These terms are governed by the law of Northern Ireland, and any dispute will be dealt with by the courts of Northern Ireland.
